====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.

It is alleged that sister of informant was married with co-accused Pramod Das in the year 2011 and from the wedlock, two children were born and thereafter, all the accused persons including this petitioner started committing torture to sister of informant due to non-fulfillment of demand of Rs. 2 lacs and one motorcycle, as dowry, and on 20.05.2023, the informant received an information that accused persons have killed his sister and disposed of her dead-body.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. There is

Patna High Court CR. MISC. No.45110 of 2025(2) dt.05-08-2025 2/2 general and omnibus allegation against the petitioner. Petitioner is nephew of the deceased and is separate in mess and property. Petitioner is not concerned with the family affairs of the deceased and is simply victim of over implication. Thrust of accusation is against husband of the deceased who is already in custody. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Masaurhi at Patna in connection with Masaurhi P. S. Case No. 345 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
