Petitioners seek Anticipatory bail in connection with Dhamdaha P.S. Case No. 76 of 2019 registered under Sections 147, 148, 149, 353,341, 323, 307, 332, 333,427,504, 506 of the Indian Penal Code.

Allegation is recovery of 05 litres of country made liquor from the house of the petitioner no.1 and allegation against petitioner no. 2 is of attacking the raiding party to get release the apprehended persons and creating obstruction in discharge of official duty of police party.

It has been submitted on behalf of petitioners that they are ladies. They have been falsely implicated in this case. There

Patna High Court CR. MISC. No.42775 of 2019(3) dt.16-11-2019 2/2 is general and omnibus allegation of gathering and obstructing police party. There is no specific allegation against these petitioners. Petitioners have no criminal antecedents except one other case of similar nature by the same informant Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, Petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 76 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
