JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 133 of 2016 arising out of Complaint Case No. 194 of 2016 for the offences punishable under sections 406, 420, 468 and 120 B of the I.P.C.

The learned counsel for the petitioner submits that the dispute between the parties has already been compromised to which the learned counsel for the opposite party no.2 denied. However, under the circumstances, considering the

No.898 of 2017 (6) dt.03-07-2017 2/2 rival contentions of the parties the petitioner is directed to surrender in the court below with the compromise petition and the learned court below after examining the genuineness of the compromise arrived at between the parties will pass appropriate order. In case of compromise arrived at between the parties, the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each and in case of compromise not arrived at between the parties, the bail should not be granted.

Accordingly, this Criminal Miscellaneous is hereby disposed of.
