JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2018 Earlier prayer for bail of the petitioners were dismissed vide order dated 09.08.2017 passed in Cr. Misc. No. 35888 of 2017 with direction to the Trial Court to conclude the trial within a period of four months and petitioners were given liberty to renew their prayer for bail if the trial is not concluded within the said period.
Submission of learned counsel for the petitioners is that uptil now trial has not commenced as charge has not been framed in this case and petitioners have been in custody sine 17.06.2017 and are ready to abide by any condition imposed on him. Hear learned APP also.
Having heard both sides, in view of the above facts as well as in view of the order dated 09.08.2017 passed in Cr. Misc. No. 35888 of 2017, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five
Patna High Court Cr.Misc. No.1907 of 2018 (2) dt.17-01-2018 2/2 Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 2771 of 2017, arising out of Agamkuan P.S. Case No. 277 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
