JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 The petitioner seeks bail in connection with Bettiah Mufasil P.S.Case No. 74 of 2000 (Tr. No. 798/2016) registered under Sections 394 of the Indian penal Code. Earlier prayer of bail of the petitioner was rejected vide order dated 21.11.2017 passed in Cr. Misc. No. 50841 of 2017. Petitioner is not named in the FIR later on his name transpires on confession of the co-accused.
Submission of learned counsel for the petitioner is that he is in custody for more than one and half years and there is not much substantial progress in the trial.
Heard learned APP also and perused the report which shows that case is pending for production of co-accused. Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,
Patna High Court Cr.Misc. No.76555 of 2018(3) dt.31-01-2019 2/2 be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No. 74 of 2000 (Tr No. 798 of 2016) with condition that petitioner shall co-operate in the trial and shall appear and when required by the trial court otherwise trial court will have liberty to cancel the bail bond of the petitioner.
Trial court is further directed to examine the address of the bailor and sureties before releasing the petitioner on bail. (Vinod Kumar Sinha, J) sujit/- U T
