In terms of the order of the Learned Single Judge on the basis of remand order passed, the DCLR has re-heard and decided the matter afresh (a copy of the decision so rendered has been brought on record with the supplementary affidavit filed on behalf of the appellant as Annexure - 3, dated 9th of June, 2016).
The Court is further informed that an appeal has also
Patna High Court LPA No.87 of 2016(19) dt.09-04-2018 3/3 been preferred against the aforesaid decision by the appellant. If this be so, then the Court will not allow arguments on the order of the Learned Single Judge, as much has happened thereafter.
The outcome of the appeal of the appellant against the order of the DCLR shall govern the future course of litigation, if the need arises.
Appeal stands disposed off in terms of the above. Since the appeal before the District Magistrate, Rohtas is pending since the year 2016, which is Appeal No. 01 of 2016, the District Magistrate, Rohtas is directed to hear and decide the appeal, preferably within a period of four months from the date of production / communication of a copy of this order, with due cooperation of all the parties.
