Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. Name of the petitioner has transpired in the confessional statement of co-accused, namely, Mahavir Yadav. The petitioner is in custody since 24.05.2017. He has not been put on TIP nor anything has been recovered from possession of the petitioner. Only on the basis of his criminal antecedent fully detail in para 3 of the bail petition, petitioner has been remanded in this case also.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.58369 of 2017 (2) dt.12-12-2017 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sasaram (Darigaon) Police Station Case No. 362 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
