JUSTICE RAVI RANJAN ORAL ORDER 05-07-2017 This application has been filed for modification of the order dated 13.05.2016 passed in Cr. Misc. No.18698 of 2016 by which the petitioner has been granted anticipatory bail with precondition that before accepting the bail bond, the court below would veryify the criminal antecedent of the petitioner as in the bail petition it was stated that the petitioner was not involved in any other case. It was directed that if the petitioner is found involved in any case then he would be taken into custody. Now, petitioner admits that he is involved in one criminal case. Wrong statement on the basis of wrong information given by the pairvikar was made in the application.

However, after some argument, learned counsel for the petitioner seeks leave to withdraw this application to surrender

Patna High Court Cr.Misc. No.30873 of 2016 (3) dt.05-07-2017 2/2 before the court below and seek regular bail. Accordingly, this application is dismissed as withdrawn with the aforesaid liberty granted to the petitioner. If the petitioner surrenders within a period of three weeks and seeks regular bail, let the court concerned consider his case on its own merit and in accordance with law without being prejudiced by the present order.
