====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-03-2021 Heard Mr. Anil Kumar Roy, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with N.D.P.S. Case No. 17 of 2020 registered for the offences punishable under Sections 20, 21 and 22 of N.D.P.S. Act. The allegation as per the First Information Report is that 7 gram 600 mg. of Heroine has been recovered from the pocket of the petitioner.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case and the provisions under Section 50 of N.D.P.S. Act has not been followed at the time of recovery of alleged Heroine from the

Learned counsel further submits that the Heroine recovered from possession of the petitioner is slightly more than the small quantity and less than the commercial quantity and the petitioner is in custody since 10.07.2020 having no criminal antecedent.

Having regard to the submissions made by the parties and taking into consideration the nature of allegation and the fact that the petitioner was caught red handed along with the Heroine, I am not inclined to grant regular bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner stands rejected.

However, the petitioner may renew his prayer for bail after nine months if the trial does not show any progress. (Anil Kumar Sinha, J) S.Ali/- U T
