JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 467 and other ancillary sections of the Indian Penal Code.

Prosecution case is that one Dhirendra Kumar was appearing in the examination for jail constable in place of the petitioner.

Learned counsel for the petitioner submits that in fact petitioner is an employee in the private firm and lives in Chennai and has no concern with the aforesaid incident. He submits that though he had also filled up exam form but he never received admit card in this regard. Petitioner has got no criminal antecedent.

Considering the nature of allegation, prayer for bail of

Patna High Court CR. MISC. No.54419 of 2021(3) dt.05-07-2022 2/2 the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar Police Station Case No. 409 of 2016, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
