Petitioner seeks bail in Benipatii P.S. Case No.19 of 2018 instituted for the offence under Section(s) 406, 409, 467, 468, 471, 420/34 Indian Penal Code.

Counsel for the petitioner submits that Panchayat Secretary has filed petition before the BDO, Benipatti, which is part of the First Information Report, stating therein that money has been withdrawn by Rambabu Yadav illegally from the account.

Counsel for the petitioner further submits that in the case diary statement of BDO is available in para 6, wherein, he has stated that Rambabu Yadav has withdrawn money. Counsel for the petitioner submits that Rambabu Yadav has been granted

Patna High Court Cr.Misc. No.76984 of 2018(3) dt.20-02-2019 2/2 anticipatory bail by co-ordinate Bench of this Court on undertaking that he will deposit entire amount in installments. He has also made payment of some installment in terms of the order of coordinate Bench dated 30.08.2018 passed in Cr. Misc. No.44171 of 2018.

Petitioner is Mukhiya and she is in custody since 07.08.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Benipatii P.S.
