This application for anticipatory bail arises out of Dhanarua P.S. Case No. 02 of 2019, disclosing the offence under Sections 302, 307, 120-B of the Indian Penal Code. Petitioner was allowed provisional bail by order dated 05.07.2019 while calling for the case diary, noticing the fact alleged in the FIR that there was specific accusation of firing on another co-accused.

Learned Additional Public Prosecutor, based on the contents of the case diary, has not been able to point out any material exhibiting petitioner's overt act.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner shall present himself before the

Patna High Court CR. MISC. No.41396 of 2019(4) dt.30-09-2019 2/2 police and court as and when required for the purpose of investigation and in course of trial.

Considering the aforesaid submission and the case diary, this application is allowed. The provisional bail granted to the petitioner vide order dated 05.07.2019 stands confirmed. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
