The petitioners seek bail in Dhamdaha P. S. Case No. 76 of 2019 instituted for the offence under Section(s) 147,148,149, 353, 341, 323, 307, 332, 333, 427, 504 and 506 of the I.P.C.

Learned counsel for petitioners has submitted that there is general and omnibus allegation in the written report against these petitioners that they along with 50-60 male and female persons attacked the raiding party and tried to get free two accused persons, namely, Shiv Lal Hembram and Sunil

Patna High Court CR. MISC. No.43151 of 2019(2) dt.17-07-2019 2/2 Hembram who were taken into custody by police after recovery of illicit liquor from their possession.

Learned counsel for petitioners has submitted that there is no allegation of specific overt act against these petitioners. They are only alleged to be member of an unlawful assembly.

Petitioners are in custody since 21.3.2019 having clean antecedent.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the CJM Purnea, in connection with Dhamdaha P. S. Case No. 76 of 2019, subject to the condition that both the bailors shall be the close relative of the petitioners.
