JUSTICE ARUN KUMAR ORAL ORDER 13-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Laheri PS Case No. 400 of 2017 registered under Sections 420, 414, 379 and 341 of the IPC.
The prosecution case is that the petitioner was withdrawing money from ATM and while apprehended by the police five ATM cards of different bank with different names were recovered, Learned Counsel for the petitioner submits that the petitioner is not said to have withdrawn any amount from the bank and there is no allegation of committing theft of any ATM card of any one, the petitioner has clean antecedent and has been in custody since 16.9.2017.
Having considered the said facts and circumstances, the petitioner, namely, Sonu Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Laheri PS Case No. 400 of 2017.
