Petitioner seeks bail in a case registered under Section 307 of Indian Penal Code.

Submission of the petitioner's counsel is that the allegations made in the first information report are highly improbable in the circumstances narrated in the first information report. He submits that, admittedly, there is some past enmity between the parties and annexing the injury report (Annexure 2), it is submitted that the doctor has found the alleged injury to be simple in nature. Petitioner is in custody since 23.08.2017 and prior to the instant case, there is no criminal antecedent of the petitioner.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge III, Hilsa, Nalanda in Sessions Trial No 665 of 2017 arising out of Chandi Police Station Case No 277 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
