JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Masaurhi P.S. Case No. 96 of 2019 for the offence under Sections 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against this petitioner is that he was involved in loot of truck. He further submits that the F.I.R. was lodged by the owner of the truck and not by the driver, in whose presence the alleged occurrence was taken place. The petitioner is in custody since 05.04.2018, on remand, yet he has not been put on T.I. Parade.
Considering the fact that the petitioner has remained in custody for more than three months, yet he has not been put on T.I.P., the petitioner, named above, is directed to be released
