The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 76 of 2021 registered under Sections 353 and 323 of the Indian Penal Code read with Section 25(1-b)a, 26 and 35 of the Arms Act.

The learned counsel submits that the petitioner is in custody since 6.2.2021, is a person with clean antecedent and charge-sheet has been submitted and the allegation is of recovery of a loaded country made pistol with one live cartridge. The learned counsel submits that petitioner has been falsely implicated in the present case and nothing was recovered from his possession.

No.56595 of 2021(2) dt.23-02-2022 2/2 Learned APP opposes the bail application and submits that learned counsel for the petitioner is trying to mislead the Court as he has concealed the antecedent of the petitioner as the impugned order very clearly records that the petitioner has five criminal antecedents and the learned counsel for the petitioner in the bail application has recorded that the petitioner is a person with clean antecedent.

Considering the submission made by the learned APP, the Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. (Satyavrat Verma, J) Ravi/- U T
