JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 467/468/471/420/323/504 of the Indian Penal Code. Petitioners are purchasers through registered sale deed on payment of consideration amount from co-accused Saroj Sah. Mother of Saroj Sah is complainant of this case. She alleged that Saroj Sah has nexus with anti-social elements and he is selling the joint family property to others.
Submission of the learned counsel for the petitioners
Patna High Court Cr.Misc. No.34005 of 2016 (5) dt.11-07-2017 2/2 is that the petitioners are bonafide purchasers. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada/Successor Court in connection with Nawada Town Police Station Case No.552 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
