1. The bail petition of the petitioner No . 1 has already been withdrawn vide order dated 27.07.2023 .
2. Heard learned counsel for the petitioner Nos. 2, 3 , 4, 5 and 6 and the State.
3 . Petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.46291 of 2023(3) dt.08-08-2023 2/3 registered for the offences punishable under sections 147, 149, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
4 . As per the prosecution case, the petitioner no. 2 has fired but no one sustained injury. Petitioner nos. 3, 4 and 5 are alleged to have assaulted the informant's side.
5. It is submitted that both parties are co-villagers and on the day of holi a scuffle took place between the parties in which both sides sustained injuries. Case and a counter case. Doctor has found simple injury. The petitioner no. 6 is alleged to be only the order giver and there is no allegation of any overt act against these petitioners. The petitioner nos. 2, 3, 4, 5 and 6 claim clean antecedent.
6. Learned counsel for the State opposes the bail petition of the petitioners.
7. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner Nos. 2, 3 , 4, 5 and 6, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Jamui in connection with Sikandra P.S.
