The petitioner apprehends his arrest in connection with Kursakanta P.S. Case No. 155 of 0217 registered under Section 7 of the Essential Commodities Act.

Block Supply Officer lodged the case alleging therein that six quintals of wheat was recovered from the house of Pawan Yadav who disclosed that he had purchased the wheat of PDF shop of the petitioner.

Learned counsel for the petitioner submits that no stock verification was made of the shop of the petitioner. No shortage is found but petitioner has been made accused on mere statement of Pawan Yadav, from whose house six quintals of

Patna High Court Cr.Misc. No.93 of 2018 (2) dt.12-01-2018 2/2 wheat was recovered.

Considering the facts and circumstances, let the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with Kursakanta P.S. Case No. 155 of 2017 to the satisfaction of the learned Sub-divisional Judicial Magistrate, Araria or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
