Mr.Ramesh Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2019 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are in custody in connection with Aurai P.S. Case No. 134 of 2019 for the offence under sections 272, 273/34 of the Indian Penal Code and section 30(a), 38(i), 38(ii) of Bihar Prohibition and Excise Act, 2016.

All the three petitioners are own brothers. They have been arrested in the instant case by the police. Allegation against the petitioners is that from their house 667.800 liters of foreign liquor was seized. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.42853 of 2019(2) dt.11-07-2019 2/2 recovery was made from the newly constructed house whereas petitioners are residing in their old house. petitioners are in custody since 6.6.2019.

Considering the submission of the petitioners that the house wherefrom liquor was seized was not of these petitioners, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Aurai P.S. Case No. 134 of 2019.
