2. The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Kaler P.S. Case No. 137 of 2024 instituted for the offence under Sections 126, 115(2), 118(1), 109, 352, 351(3) and 3(5) of the BNS.

3. The case of the prosecution is that the accused persons including the petitioner being armed with lathi, danda and sword arrived and started abusing the mother of the informant. They also started assaulting with lathi. It is further alleged that on 16.10.2024 at about 7 AM when the informant has gone in his fields, all the accused persons being armed with lathi, danda and sword assaulted Suman Kumar. It is further alleged that Ranjit assaulted Sintu with sword.

4. Learned counsel for the petitioner has submitted that from perusal of the FIR it is clear that though the petitioner has

It has also been submitted that there is also a counter version of this case. The petitioner herself had filed a case that the informant and others have assaulted her. The petitioner is an old lady of 71 years having clean antecedent.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Kaler P.S. Case No. 137 of 2024, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Arwal subject to the conditions as laid down under Section 482(2) of the BNSS.

7. Accordingly, the present bail application stand allowed.
