JUSTICE BIRENDRA KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 272,273/34 of the Indian Penal Code and 30(A) of Bihar Excise & Prohibition Act, 2016. The petitioner is in custody since 13.09.2017. Allegation is that Nepali as well as foreign liquor was allegedly recovered from the possession of the petitioners.

Considering the nature of allegation and period already undergone by the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/-

Patna High Court Cr.Misc. No.5178 of 2018 (2) dt.31-01-2018 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ghorsahan Police Station Case No.462 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
