JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Earlier prayer for bail of the petitioner was rejected by this Court twice vide order dated 9.11.2017 in Cr.Misc.No. 49582 of 2017 and vide order dated 11.7.2018 passed in Cr.Misc.No. 41618 of 2018 considering the allegation of rape against the petitioner.

Submission of learned counsel for the petitioner is that petitioner is in custody since 9.7.2017 and there is no substantial progress in trial till date.

Heard learned APP and perused the report, from which it appears that out of five witnesses three have been examined and from the report of S.P. it appears that he has directed the Officer-in-Charge of concerned Police Station to produce rest of the witnesses in court on the date fixed and

Patna High Court Cr.Misc. No.78908 of 2018(3) dt.23-01-2019 2/2 considering the same, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected. With the above observation, this application is dismissed.
