The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 307 and other allied sections of the Indian Penal Code. As per the prosecution case, all the accused persons including petitioner assaulted the husband of informant and her father-in-law. Father-in-law of informant died during course of treatment.
It is submitted that specific accusation of assault is against Biju Bhagat and Rajendra Bhagat. So far as petitioners are concerned, there is general and omnibus allegation. Both parties are agnates and land dispute is going on between them. Petitioner claims clean antecedent.

No.44611 of 2022(3) dt.13-12-2022 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Rajepur P.S. Case No. 51 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
