Heard learned counsel for the petitioner and the learned A.P.P. for the State thorough Video Conferencing. The petitioner apprehends his arrest in connection with Paliganj P.S. Case No. 80 of 2017, registered under Sections 420, 406 and 409 of the Indian Penal Code. The accusation is that, on receiving complaint about the irregularity committed in Manrega scheme in Panchayat Masorha Jalalpur of Paliganj Block, inquiry was made and
Patna High Court CR. MISC. No.39503 of 2020(2) dt.16-07-2021 2/3 irregularity was found, fixing the liability of the then Mukhiya, Sanjiv Singh and the then Panchayat Secretary Sri Hari Nandan Prasad Singh.
Learned counsel for the petitioner submits that inquiry was made regarding the Manrega scheme for the period of 2002 to 2010 but later on, petitioner has been implicated in the present case with false allegation as he being the Block Development Officer, Paliganj taken in-charge of Programe Officer for six months. It is further submitted that co-accused, Sanjiv Singh, Shailja Nandan and Arun Kumar, respectively, were Mukhiya, Junior Engineer and Gram Shevak of Panchayat Masorha Jalalpur of Paliganj Block, have already been granted privilege of pre-arrest bail by the different Courts, respectively, vide order dated 15.01.2018, 14.08.2018 and 24.09.2018 passed in Criminal Misc. No. 52472 of 2017, Criminal Misc. No. 47452 of 2018 and Criminal Misc. No. 49550 of 2018, which would appear from annexure 2 series of the petition.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.39503 of 2020(2) dt.16-07-2021 3/3 amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Danapur, Patna, in connection with Paliganj P.S. Case No. 80 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
