The petitioner seeks bail in Barhara P.S. Case No. 257 of 2019 corresponding to Sessions Trial No. 51 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code and section 27 of the Arms Act. Earlier the bail application of petitioner was rejected vide order dated 27.11.2020. Vide order dated 27.10.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that charge has been framed on 07.01.2021 and summons have been issued, but till date no witness turned up for deposition. It is submitted that petitioner is in custody since 22.07.2019 In para 3 of the petition, it is stated that petitioner is

Considering the period of custody and the fact that there is no headway in the trial, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VIII, Bhojpur, Ara in connection with Barhara P.S. Case No. 257 of 2019 corresponding to Sessions Trial No. 51 of 2020.
