JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 14.11.2017 passed in Cr. Misc. No. 49399 of 2017 and the case is under Section 396 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 02.03.2017 and save and except the confessional statement there is nothing against the petitioner and other co-accused persons have already been enlarged on bail by different coordinate Benches of this Court vide order dated 08.05.2018 passed in Cr. Misc. No. 21308 of 2018, vide order dated 20.07.2018 passed in Cr. Misc. No. 43938 and vide order dated 27.07.2018 passed in Cr. Misc. No. 45728 of 2018 and there is no substantial progress in trial.

Having heard both sides and perused the report of learned court below, from which, it appears that uptil now no witness has been examined, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 3rd, Hilsa, Nalanda, in connection with Hilsa P.S. Case No. 340 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
