The petitioner apprehends his arrest in connection with Barauni P.S. Case No.155 of 2015 registered for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The processes under Sections 82 and 83 of the Code of Criminal Procedure have been executed against the petitioner in the year 2016 and now the petitioner has approached this Court for anticipatory bail.

In view of law laid down by the Hon'ble Supreme Court in the case of Prem Shankar Prasad Vs. The State of Bihar and Anr. (Criminal Appeal No. 1209 of 2021), this application for anticipatory bail is not maintainable. Hence, it is

The petitioner is directed to surrender and pray for regular bail before the court below within two weeks from today which shall be considered by the court below on its own merits without being prejudiced by the fact that anticipatory bail petition has been rejected by this Court.
