1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Barhara P.S. Case No. 35 of 2023 dated 19.01.2023 registered for the offence(s) punishable under Section(s) 147, 148, 149, 341, 323, 324, 325, 307, 302 and 504 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that petitioner is a lady and against her, there is no specific allegation and altogether 20 persons including the petitioner have been named in the FIR, though in the present matter informant's daughter succumbed to her injury but she sustained only one head injury and the same has been discussed in the order impugned and the assault on the said victim has not been specifically attributed against this

Patna High Court CR. MISC. No.45160 of 2023(2) dt.27-07-2023 2/2 petitioner, in fact there is a land dispute in between the coaccused Prabhu Mandal and prosecution party and there is also a case and counter case in between them.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the facts that the petitioner is a lady and in the FIR, there is no specific allegation against her and several persons have been named in the FIR and as per above submissions, there is a land dispute in between both the parties, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Barhara P.S. Case No. 35 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
