The petitioner seeks bail in connection with Ujjiarpur P.S. Case No. 28 of 2015 dated 21.02.2015 instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code. The deceased is the niece of the informant, who because of being ill-treated by her ex-husband Pramod Rai, chose to marry the cousin of Pramod Rai viz. Vikas Rai. Later, the family members of aforesaid Vikas Rai tortured and killed the deceased. The petitioner happens to be the brother-in-law of the ex-husband of the deceased. There is no specific allegation in the FIR against the petitioner.

Regard being had to the aforesaid facts and also taking into account the period of custody of the petitioner which is

Patna High Court Cr.Misc. No.57038 of 2017 (2) dt.05-12-2017 from 24.09.2017, this Court is inclined to grant bail to the petitioner.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 3rd Dalsingsarai, Samastipur in connection with Ujjiarpur P.S.
