JUSTICE ARUN KUMAR ORAL ORDER 17-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Salaiya PS Case No. 34 of 2014 registered under Sections 147, 148, 149 and 435 of the IPC, Section 27 of the Arms Act and Section 17 of the CLA Act. Submission is that the persons who were retreating back after setting fire the mobile tower were raising slogans naming the petitioner and others and it is not that he was identified by any other person. Charge-sheet has been submitted in this case and the petitioner is in custody since 15.7.

2017 Having considered the said facts and circumstances, the petitioner, namely, Kapil Bhuiyan @ Tapeshwar Bhuiyan @ Kail Bhuiyan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Salaiya PS Case No. 34 of 2014.
