1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Jalalgarh P.S. Case No. 140 of 2022 dated 11.08.2022 registered for the offence(s) punishable under Section(s) 461 and 379 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent, though the instant matter relates to theft committed in respect of four shops in the same night but the FIR was registered against unknown and during the course of investigation the petitioner has been made accused merely on account of recovery of inverter, battery and some soaps of different brands but the said recovered materials are not

No.45159 of 2023(2) dt.27-07-2023 2/2 sufficient to show the involvement of the petitioner in the alleged crime of theft and moreover the alleged offences are triable in the court of 1st Class Magistrate and against the petitioner, the investigation has been completed and he has been languishing in jail since 02.05.2023.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's young age and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Jalalgarh P.S. Case No. 140 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
