The petitioner seeks bail in a case registered for the offence punishable under Sections 376, 354(c), 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he circulated the objectionable photo of the informant from his mobile. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that according to the FIR, the informant alleges that the petitioner from his mobile has circulated objectionable photos of the informant. He submits that informant has not alleged anything specific in her statement under Section 164 Cr.P.C. against the petitioner. He further submits that petitioner bears no criminal antecedent as stated in
Patna High Court CR. MISC. No.39853 of 2020(3) dt.17-03-2021 2/2 para-3 of the bail petition and he is languishing in judicial custody since 26.02.2020.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Kursela P.S. Case No. 89 of 2020.
