The petitioner is languishing in custody since 09.08.2018 in a case registered for the offences punishable under Sections 467, 468, 471, 414 of the Indian Penal Code and Sections 30(a) and 30(b) of the Bihar Prohibition and Excise Act, 2016.
It is alleged that from the motorcycle of the petitioner, 6 litres of illicit country made liquor were recovered. It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent and the investigation has already been concluded.
Learned APP submits that the recovery has been made from the possession of the petitioner.
