Mr. Parmeshwar Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-09-2022 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned senior counsel for the petitioner submits that petitioner is a person with clean antecedent and is a PDS dealer for the last 25 years and the informant alleges that rice of PDS was being carried for black-marketing and altogether 17 gunny bags of rice were recovered from the vehicle bearing Registration No. BR-11-GB-3592, it is next alleged that on spot verification the informant found that there was discrepancy in ePOS machine and the ration distributed from physical stock verification, it is further alleged that as such the stock was

No.43719 of 2022(2) dt.01-09-2022 2/3 disproportionate to the receipt of the e-POS machine and altogether 3733 Kg of rice and 984Kg of wheat was found in excess, which amply demonstrates that the dealer was providing the ration to the beneficiary in lesser amount. Learned senior counsel for the petitioner submits that petitioner is a PDS dealer for the last 25 years and in these 25 years no case ever came to be instituted against him, it is next submitted that allegation is of finding grain in excess, it is also submitted that FIR does not even remotely suggest that any beneficiary had complaint that they were receiving amount less than what they were entitled, it is thus submitted that entire the allegation thus hinges around suspicion, learned senior counsel for the petitioner next submits that petitioner has already suffered and even his license has been suspended, leaving him without any livelihood.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

No.43719 of 2022(2) dt.01-09-2022 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Asarganj P.S. Case No. 83 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
