Petitioner, already in custody, seeks bail in connection with Shamho P.S. Case No.38 of 2015, registered under Sections 147, 149, 341, 323, 384, 427, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation is false, petitioner is not the contractor of the said project of construction of the road for which soil was alleged to be cut away from the plot of the informant, this present case was lodged after a delay of approximately one month without any explanation, another co-accused Rajesh Kumar @ Bittu having similar allegation was granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No.8378 of 2016 on
Patna High Court Cr.Misc. No.58002 of 2017 (2) dt.14-12-2017 2 /2 07.09.2016 and this petitioner is in custody since 10.10.2017. Having considered the said facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Begusarai in connection with Shamho P.S. Case No.38 of 2015 with condition that one of the bailors must be the family member of the petitioner.
