JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection withDehri (T) P.S. Case No. 377 of 2016, registered under Sections 147, 149, 337, 353, 379 and 411 of the Indian Penal Code, Section 4(1-A)21, (I) of D.E. Act, Section 40(1) B.M. Act and 33, 41 and 42 of the Indian Forest Act.

The accusation is that in the light of the direction of the higher authority, a raiding team was constituted including the informant, Officer-In-Charge of Dehri P.S., Dalmiyanagar P.S., Harihar P.S., Aghauri Gola P.S., Tilaunu P.S., Sasaram (Muffasil) P.S., SDPO Dehri and other officials for checking the running of illegal stone crusher machines. Accordingly, 103 crusher machines were damaged by J.C.B. At that time, 12 persons came there with

Patna High Court Cr.Misc. No.45923 of 2016 (3) dt.28-07-2017 2/2 procession and started pelting stones and bricks. It has also come to knowledge that one crusher was also being run by this petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (T) P.S. Case No. 377 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
