In this case, the petitioner is seeking anticipatory bail in connection with Rishiyap P.S. Case No. 40 of 2019 registered for offence punishable under sections 147, 149, 186, 189, 224, 225, 341, 323, 353/504 of the Indian Penal Code. The police received an information that Guddu Singh, the present petitioner was in his house and the police party had gone to his village and when the police party asked him to accompany them, he started raising voice and called the family members and others whereupon male and female family members including the villagers had assembled and scuffled with the police party and they refused to hand over the present
Patna High Court CR. MISC. No.42136 of 2019(3) dt.07-08-2019 2/2 petitioner and taking benefit of the aquatic situation, the petitioner fled away from there.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
