JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners seek bail in Shambhuganj P.S. Case No. 293 of 2024, registered for offence under Sections 137(2) and 140(3) of the B.N.S., 2023 and later on, Sections 140(1), 103(1), 233(a) of B.N.S., 2023 were added in the F.I.R.
3. The prosecution case, in brief, is that informant Nidhu Singh alleged that n 14.10.2024, her son went for a walk towards Durga Mandir at about 5 PM, but he did not return. The
Patna High Court CR. MISC. No.44347 of 2025(2) dt.22-08-2025 2/3 informant and her family members searched for him, but the victim could not be traced and then, she lodged this F.I.R. Belatedly, the dead-body of son of informant was found in an agricultural field.
4. F.I.R. has been lodged against unknown. Name of the petitioners surfaced during course of investigation in the confessional statement of co-accused Ajit Kumar Singh @ Jhakho Singh. There is no eye-witness to the occurrence. Petitioners happen to be co-villagers of Amrita, with whom, the deceased was having love-affairs. After investigation, police submitted chargesheet under Section 238 of the B.N.S., 2023. Petitioners are in custody since 19.03.2025.
5. Learned counsel for the informant vehemently opposes the prayer for bail of petitioners and submits that petitioners may not be extended the privilege of bail, since they have facilitated other accused persons in disposal of dead-body of deceased.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka /
