The petitioner is in custody in connection with Special (POCSO) Act Case No. 38 of 2017 corresponding to Araria P.S. Case No. 444 of 2017, a case under Sections 363, 366/A of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the daughter of the informant.

Learned counsel for the petitioner has submitted that the statement of the victim girl reveals that the matter is of love affair. Both have already married.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.3282 of 2018 (2) dt.17-01-2018 2/2 amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special (POCSO) Act Case No. 38 of 2017 corresponding to Araria Police Station Case No. 444 of 0217 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
