The petitioner seeks bail in connection with Banmankhi P.S. Case No. 18 of 2017 dated 27.01.2017 instituted for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Nine named accused persons, the petitioner being one of them, are alleged to have opened fire at the deceased, leading to his death.

Learned counsel for the petitioner has submitted that some of the other co-accused persons have been granted bail by coordinate Benches of this Court. From one of the orders annexed to the petition, it appears that the deceased has suffered only one gun shot wound which had led to his death.

Patna High Court Cr.Misc. No.57027 of 2017 (2) dt.05-12-2017 The petitioner is in custody since 09.10.2017 and does not have any criminal case against him.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S. Case No. 18 of 2017.
