A supplementary affidavit to that effect has been filed today in Court. Let it be kept on record.

Heard the learned counsels for the petitioner and the State.

The petitioner seeks bail in connection with Special (N.D.P.S.) Case No. 190 of 2017, arising out of Fatuha P.S. Case No. 566 of 2017 dated 12.12.2017 instituted for the offences under Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The petitioner was found to be occupying a vehicle from where 10 grams of Ganja was recovered.

Patna High Court Cr.Misc. No.63029 of 2017 (2) dt.05-01-2018 Learned counsel for the petitioner has submitted that the petitioner along with his friends was coming back to Patna when, on way, he was wrongly intercepted and coming to know about his family background, was falsely implicated in the present case by the police. It has further been submitted that two other occupants of the vehicle have been granted bail by this Court. It has also been submitted that nothing has been recovered from the exclusive possession of the petitioner and 10 grams of Ganja only has been recovered from the vehicle in which the petitioner was found to be sitting.

The petitioner has clean antecedent and has been a student of B. Tech. from Dehradun.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Patna in connection with Special (N.D.P.S.) Case No. 190 of 2017, arising out of Fatuha P.S. Case No. 566 of 2017.
