2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 228.750 illicit liquor has been recovered from the seized tempo and the house of the petitioner and other co-accused.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner and has been implicated in this case only on suspicion. Recovery has been made from the house and tempo of the petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the fact that petitioner is registered owner of the tempo, from which, aforesaid recovery has been effected, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) Saif/- U T
