The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 15 litres Nepali saufi was recovered from the bag of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 20.09.2017, i.e., more than two months. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.56156 of 2017(2) dt.23-11-2017 2/2 satisfaction of the 7th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran at Motihari in connection with Excise Case No.258/2017 arising out of Excise PR No.21/17-18 (Dhaka).
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
