The petitioner seeks bail in anticipation of his arrest in connection with Desari P.S. Case No. 209 of 2018 dated 02.08.2018 instituted for the offence under Section 392 of the Indian Penal Code.

The FIR is against unknown. The informant is said to have been divested of the money which he was carrying by accused persons. The name of the petitioner has transpired in this case on the basis of confession of an arrested accused person. Apart from the confession, there is no other material to connect the petitioner with the offence.

It has also been submitted on behalf of the

No.3972 of 2021(2) dt.05-08-2021 2/2 petitioner that two of the accused persons of this case have been chargesheeted, but the investigation appears to have been kept pending against the petitioner. Though the petitioner was earlier made accused in a number of cases but in all these cases, his implication is very doubtful and in all such cases he is on bail. Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 209 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
