The petitioner seeks bail in Supaul Mahila P.S. Case No. 35/2018, instituted for offence under Section(s) 493 of the Indian Penal Code.

It is alleged in the written report that this petitioner, who is Devar of informant, after death of husband of informant established physical relation with her on the pretext of performing marriage. Later on petitioner refused to perform marriage. It is mentioned in the written report that informant has three minor children.

Learned counsel for the petitioner has submitted that informant is major lady, even if the relationship was established then it cannot be said to be without the knowledge of informant.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Supaul Mahila P.S. Case No. 35/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
