Petitioner is apprehending his arrest in connection with Barun P.S.case No.65 of 2019 , registered for offences punishable under Sections 379, 411, 420 and 34 of the Indian Penal Code and Section 4/40 BMMCR and Section 15 of Environment Protection Act.
Prosecution story is that several tractors were seized loaded with sand and the Driver who happens to be driver cum owner of one of the tractors succeeded in fleeing away. Submission of the learned counsel for the petitioner is that he has valid challan for the sand trade but the same has not been considered.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Barun P.S.Case No.65 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
