2. The petitioner seeks regular bail in the present case registered for the offence under Sections 363, 365 of the Indian Penal Code and Section 8, 12 of the POCSO Act.

3. The victim in her statement recorded under Section 164 of the Cr.P.C., has not supported the prosecution case. She left her house at her own, eloped with the petitioner and got married to him.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 01.04.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Special Judge (POCSO Act), Bettiah, West Champaran/concerned Court below in connection with Bairiya P.S. Case No. 364 of 2023.

8. This application stands allowed.
