Petitioner apprehends his arrest in Bakhari P.S. Case No.26 of 2016, registered under Section 302 and 201 of the Indian Penal Code and under Section 27 of the Arms Act. The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 19.05.2017, passed in Cr. Misc. No.16257 of 2017 but again the petitioner moved this Court for grant of anticipatory bail on the ground that the petitioner is an old man and he is ailing from different ailments. The petitioner has got criminal antecedents and he is accused in at least two other cases registered under Section 302 and other sections of the Indian Penal Code.

Considering the nature of allegation and the fact that the petitioner has got criminal antecedents, the prayer for

Patna High Court CR. MISC. No.44481 of 2019(2) dt.31-07-2019 2/2 anticipatory bail of the petitioner was rejected but the petitioner did not surrender in the court for more than two years and for the reason that he is ailing, moved this Court again for grant of anticipatory bail.

I do not find any reason to consider the prayer for anticipatory bail of the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
